Client Terms
These Client Terms outline the general policies for projects completed by Jen Epstein Designs. Project-specific details—including scope, deliverables, timeline, pricing, and usage rights—will be outlined in the individual proposal, estimate, invoice, or agreement provided for each project.
Payment
A deposit may be required before work begins. The deposit amount and remaining payment schedule will be outlined in the project agreement or invoice.
Final payment is due according to the terms listed on the invoice. Final, production-ready deliverables may be withheld until all outstanding balances associated with the work have been paid in full.
Ownership & Usage Rights
All concepts, designs, artwork, and deliverables remain the intellectual property of Jen Epstein Designs until payment for the applicable work has been received in full.
Work provided for review or approval prior to payment is considered a proof and may not be published, reproduced, distributed, modified, printed, posted to social media, or otherwise used without permission.
Upon receipt of full payment, the client is granted the usage rights specified for the final approved deliverables in the individual project agreement. Preliminary concepts, unused designs, working files, and rejected directions remain the property of Jen Epstein Designs unless otherwise agreed upon in writing.
Source & Editable Files
Final deliverables include the file types specified in the project agreement. Editable or working files—including Adobe Illustrator, Photoshop, InDesign, Canva, or other source files—are not automatically included unless specifically stated in the project scope.
Source or editable files may be available upon request and may be subject to an additional fee.
Revisions
The number of revision rounds included in a project will be established before work begins.
Requests that exceed the included revisions or substantially change the previously approved direction may be considered additional work and billed accordingly. Any additional charges will be communicated before that work begins.
Changes in Scope
Project pricing is based on the agreed-upon scope and deliverables. Requests for additional designs, formats, applications, concepts, or services outside that scope may require an additional fee.
Changes to the scope will be discussed and approved before additional work is completed.
Project Cancellation
If a client chooses to cancel or discontinue a project after work has begun, payments already made are non-refundable and will be applied toward time and work completed up to the date of cancellation.
If completed work exceeds the value of payments already received, Jen Epstein Designs reserves the right to invoice for additional work completed through the cancellation date.
Unpaid or unfinished work may not be used by the client unless otherwise agreed upon in writing.
Project Inactivity
If client feedback, materials, approvals, or communication required to continue a project are not received for an extended period, the project may be considered inactive.
Timelines for inactive projects may need to be rescheduled based on current availability. Projects that remain inactive for an extended period may require a new timeline or updated estimate before work resumes.
Third-Party Costs
Printing, stock photography, fonts, licensing, web hosting, advertising costs, or other third-party expenses are not included unless specifically stated in the project agreement.
Any additional third-party expenses requiring client payment will be communicated before purchase whenever possible.
Final Approval
Clients are responsible for reviewing and approving final designs, including spelling, dates, contact information, pricing, event details, and other content, before files are sent to print or published.
Jen Epstein Designs is not responsible for errors discovered after final client approval.
Printing & Production
Every effort is made to prepare files according to appropriate production specifications. However, variations in color, materials, printing processes, displays, and third-party production methods may occur.
Jen Epstein Designs is not responsible for errors or quality issues introduced by third-party printers, manufacturers, platforms, or vendors after correctly prepared files have been delivered.
Portfolio & Promotional Use
Jen Epstein Designs reserves the right to display completed work for portfolio, website, social media, award submission, and self-promotional purposes unless confidentiality or other restrictions have been agreed upon in writing.
Work may be presented in context as part of the design and creative process, including concepts or directions that were developed for a project but were not ultimately published or implemented by the client.
Confidentiality
Any confidential information provided by a client will be treated appropriately and will not knowingly be disclosed publicly before it has been released by the client.
If a project requires a formal non-disclosure agreement or specific confidentiality restrictions, those requirements should be established before work begins.
Acceptance of Project Terms
Project-specific agreements, proposals, estimates, and invoices may contain additional or different terms. In the event of a conflict, the terms agreed upon for the individual project will take precedence over these general Client Terms.
By approving a project agreement or proceeding with commissioned work, the client acknowledges the terms applicable to that project.
Portfolio & Promotional Use
Jen Epstein Designs reserves the right to display completed, unpublished, unused, or unpaid work for portfolio and promotional purposes. Displaying such work does not grant the client usage rights. Unpaid or unused concepts remain the property of Jen Epstein Designs and may not be reproduced, published, modified, or otherwise used without written permission and applicable payment.
